My Time Fishing Charters Terms & Conditions

I, Captain Nick Gonzalez, certify that I retain a Captain License issued by the U.S. Coast Guard and I am legally qualified to take passengers on inshore and nearshore fishing charters. I will not take unnecessary risks and will avoid bad weather to the fullest possible extent. My main goal is to provide a trip that are both memorable and safe.

We, the undersigned, fully understand that we are embarking a charter fishing vessel to fish inshore and nearshore and assume the risks and hazards associated with it. I understand there are risks involved with boating, fishing, and passenger activities, included but not limited to boarding or disembarking the vessel, equipment failure, perils of the sea, weather conditions, harm caused by marine live like marine and fish bites, entering and exiting the water, injuries by fishing equipment, equipment failure, slippery and wet decks, or acts of fellow participants.

I understand that I have a duty to use reasonable care for my own safety and I promise to do so. I also assured that I am physically able to ride on a boat in any condition, able to swim, and able to fish. I understand that the involved vessel has limited medicla facilities and in the event of a medical emergency, medicla care will be summoned via VHF radio or/and cell phone and treatment could be delayed until you can be transported to a proper medical facility.

Furthermore, I promise that I will not bring onboard the vessel any illegal substances and I release Captain Nick Gonzalez from any liabilities for any illegal actions taken by myself on the vessel. Finally, I certify that I am not bringing onboard the vessel any electronic devices, GPS and/or Loran devices.

I have read and understood this contract in its entirety and agree to the terms and conditions on behalf of myself, my heirs, and any personal representatives. I give up my right to sue My Time Fishing Charters LLC, Captain Nick Gonzalez or entities referred herein, whether specifically named or not, and to hold these entities harmless from any and all liability for personal damage, personal injury or wrongful death caused by negligence or gross negligence and I assume all risk in connection to fishing, swimming, snorkeling, riding and all other boating activities.
